1.    General Terms and Conditions of Sale
1.1     We only supply products as Not For Human Consumption and as a raw product (unless otherwise stated).


1.2     Care is taken to provide products that are free from harmful bacteria and inhibitory substances but the nature of the product is such that we cannot guarantee this.  Where an issue regarding milk quality is identified by us, we will either delay dispatch of products or notify you via email of the issue.


1.3     Where dispatch is either delayed or you are notified of an issue with the milk, we will dispatch fresh milk as soon as the issue is resolved. Where it is important to you to have an on-going supply of product, we recommend ensuring you allow for some over-lap of orders.


1.4     Please check that your order details are correct before confirming the order.


1.5     You must ensure that the details provided by you as part of the checkout process are correct, and inform us immediately of any changes to your personal details.


1.6     Recurring orders can be amended or cancelled at any time up to 1 pm on the day prior to the day of dispatch. If you are going on holiday or you will be absent from your delivery address for a period of time and you would like to suspend your Recurring Order deliveries or have them delivered to an alternate address please contact us before 1 pm on the day prior to your scheduled delivery with the details and duration of your absence. This can be done via the Stripe Portal by following this link.


1.7     If you make any amendments to an order after payment has been taken, then you will either be refunded for the price of the products previously ordered but not yet delivered, or will be charged separately for the new products ordered.

 

1.8     Products are not be supplied for the purposes of resale, and are only supplied for your own use as a consumer, unless otherwise agreed upon in writing.


1.9    The packaging of products may vary from that shown on images on the website or social media networks.

 

 

2.    Types of Orders
2.1     One-off Orders – this is an order for products you order once for a particular delivery day. One-Off Orders are be payable at the time of ordering using debit or credit card via Stripe or can be deposited into our bank account using the account details provided during the Bank Transfer checkout process.  Payments using the Bank Transfer method must be showing in our account before products will be shipped.


2.2     Recurring Orders (Subscription Service) - this is an order for products you select to be delivered regularly each week, fortnight or every 4 weeks (’monthly’)  without the need to manually re-order each time. Payments for recurring orders are made via Stripe Payment Links.  Accepted methods include debit or credit card and ApplePay.

 


3.    Pricing
3.1     We take all reasonable care to ensure that the prices of products are correct at the time when the relevant information was entered onto the system.  All prices are subject to change.


3.2     The price of the products may vary depending on whether you place a One-Off Order or a Recurring Order and the average 4-weekly volume of recurring orders.


3.3     For One-Off Orders, the price of the products will be as quoted on the website at the time you place your order. If you amend a confirmed order prior to delivery, the prices charged for the new item(s) will be those applicable at the time that the amended order is confirmed.


3.4     For Recurring Orders, the initial price of the products will be as quoted on the website at the time you set up your Recurring Order. If you have set up a Recurring Order, the price for products in future orders may differ from the price of those products originally ordered by you. Customers will be notified via email of any changes to prices for products in recurring orders and under such circumstances you will be given the option to cancel any further orders if the new pricing is no longer acceptable to you.


3.5     At times, promotional pricing may apply. The time-frames and conditions of eligibility for any promotional pricing will be displayed on the website and/or social media platforms.


3.6     All prices stated will be inclusive of any GST payable, unless otherwise stated.

 

 

4.    Order Confirmations
4.1     After you place an order, you will receive an automated e-mail from us acknowledging that we have received your order.


4.2     Orders are not dispatched daily.  The current delivery schedule and cut off times are listed on the website under Ordering & Deliveries.


4.3     You will only receive an initial email acknowledging confirmation and acceptance of Recurring Orders. You will not receive subsequent order confirmations unless you cancel or amend a Recurring Order.

 

 

5.    Payment Details
5.1     Our website does not store any of your payment information, however there is an option for Stripe to save your details for future use.  Payment details will be recorded automatically when Recurring Orders are placed and your card will be charged automatically at the frequency indicated in your subscription choice.


5.2     If at any time you wish to change your payment method, or there is a change in your card details, you may edit your payment details through the “My Account” section of the Website.

 

 

6.    Payment Failures
6.1     In the event that a payment failure for a Recurring Order occurs, we will endeavour to contact you prior to the dispatch date to get updated details.  If this is not successful, we reserve the right to suspend your account and any further deliveries until the issue is resolved.

 


7.    Delivery Costs
7.1     Delivery costs are additional to the listed product costs.  


7.2     For one-off orders, the delivery cost will be applied when you checkout.  Indicative rates are shown on the Ordering & Deliveries page of the website. Where there is a discrepancy, the rate indicated in the checkout process shall be deemed the correct one.


7.3     For Recurring Orders, the delivery costs are included in the pricing for each particular subscription choice.


7.4     Delivery prices vary according to order quantities and delivery location. It is the customer’s responsibility to select the correct delivery region at checkout / when selecting subscription links for recurring orders.


7.5     Deliveries will generally be made by either NZ Courier Post or Aramex, but alternative courier services may be used by us as required.  The target delivery for urban addresses is the next working day however we do not take responsibility for delayed orders and any subsequent deterioration of products as a result of this.  If you do experience delivery delays please let us know so we can amend our service providers and/or seek compensation where applicable.


7.6     Whist we do ship to rural addresses, we advise customers to utilise urban addresses to self-collect from where possible.

 


8.    Product Availability
8.1     All products are subject to availability and prevailing supply conditions. We may at our discretion limit the quantities of products supplied to any customer if in our opinion the quantity ordered jeopardises availability for other customers.


8.2     We may make changes to product ranges from time to time. Where we are removing a product from the range we will always contact you if you have such an item as part of your Recurring Order, to advise you of its removal.


8.3     If we are unable to supply you with products, for example because those products are not in stock, no longer available or because we cannot meet the scheduled delivery date we will process a refund for the full amount paid for such items.  If a product is permanently discontinued, we will advise you with as much notice as possible of its unavailability.

 

 

9.    Defective or Incomplete Products
9.1     If you believe that any of the products you have received do not match their description as listed on our website, is not of satisfactory quality, does not meet any relevant guarantee we have made, or is otherwise faulty, then please contact us via email or messenger and we will do our best to help you and, where applicable, arrange for a replacement. If a replacement is not appropriate, a refund may be offered. We reserve the right to ask you to send us reasonable evidence of any of the products affected by such issues.  Any concerns regarding perishable items must be raised prior to the expiration date of the product.


9.2     Perishable products are unable to be returned once they have been dispatched nor are orders able to be cancelled unless notification is made before 1 pm on the day prior to the scheduled dispatch. If you order arrives in unsatisfactory condition, please contact us via email as soon as possible.

 

 

10.    Refund and Replacements
10.1     Where a product is replaced, it will be done so free of charge, including postage and packaging.


10.2     Where a refund is offered, it will be done so using the same payment method as was used by you when ordering the product.

 

 

11.    Events Outside Our Control
11.1     We will not be liable or responsible for any failure or delay to deliver products or any of our obligations under a contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including, but not limited to, power outages, courier service disruptions, strikes, lock-outs, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, cyber-attack, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport or disruption to the website or email service.


11.2     If an Event Outside Our Control takes place that affects the performance of our obligations under a recurring order agreement, we will contact you as soon as reasonably possible to notify you, our obligations under the contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

 

 

12.    Privacy
12.1     We are committed to preserving your privacy. The personal information you provide will enable us to provide you with the products you require. We will not transfer, disclose, sell, distribute or lease your personal information to third parties.
